Assets of community value

The nomination process

We must decide within 8 weeks of nomintation whether to include a community nomination in the list.

A panel of Council Officers assess whether the asset should be included on the Assets of Community Value register against criteria set out in The Assets of Community Value (England) Regulations 2012.

If the asset does not meet the criteria set out, this is published on the list of unsucessful applications and the - 

  • owner
  • occupier
  • group who made the nomintation

are all notified of the outcome. We are required to maintain a list of unsuccessful nominations to provide transparency. It is also to deter repeat nominations.

If the asset meets the criteria, it is published on the successful nominations list. Local Land Charges Officers are notified to register the Asset of Community Value on the Local Land Register. Legal team are also notified for a registration of restriction against Land Registry title if the land is registered and the - 

  • owner
  • occupier
  • group who made the nomintation

are all notified of the outcome.

Review or appeals against a decision

We are required to provide a right of review to the owner against inclusion of an asset on the register.

The owner will have 8 weeks from notification of the inclusion of the asset on the register to request a review. The review must be completed within 8 weeks unless otherwise agreed with the owner. The owner has the right to request an oral hearing and to be represented.

If this review is successful for the owner, the asset is removed from the list and all involved parties are informed of the outcome with a copy of reasons for the decision provided.

If after a review we decide to uphold the original decision and continue to include the asset on the register, the owner may appeal against the decision to the First-Tier tribunal. This is an independent tribunal managed independently of us.
