Fly-tipping on private land

If fly-tipping has taken place on private property, it is the responsibility of the owner or occupier of the land to remove and dispose of lawfully. This is even if you did not deposit the waste. Failure to do so this may result in action being taken by the council. This is to make sure the land is cleared, and the waste is disposed of lawfully.

If on clearing fly-tipped waste from your property you can provide -

  • photos or mobile video showing details found in the wastes you have cleared. They may help to identify who produced it or where it may have come from
  • CCTV footage of waste being fly-tipped by persons or vehicles
  • information about who was responsible

If we are successful in any enforcement action taken, owners of private land affected by fly-tipping may be able to recover any costs they have incurred through the courts.

If you need to remove and dispose of fly-tipped waste from your land and are paying someone else to do this for you, you must always -

  • make sure they are an authorised person and registered with the Environment Agency. They are commonly known as registered waste carriers
  • get documents in the form of controlled waste transfer notes from person you have paid to remove and dispose of wastes. This can be used as proof of how and where you have disposed of the waste
