Pavement Licence Process
On 26 October 2023, the Levelling-Up and Regeneration Act 2023 has amended the Business and Planning Act 2020, making the changes relating to pavement licences permanent.
While the application process remains the same, there are some changes to make note of -
Fees are non-fundable and are -
- £350 if the application is being made by someone who previously held a pavement licence, including if the application is a renewal
- £500 in any other case
We still have up to 14 days to determine a valid application, which includes a mandatory 7 day consultation period. In all cases, proof of registration and completing the nationally recognised counterterrorism ACT eLearning training product is required.
From 31 March 2024, new guidance makes it clear that a minimum width of 2000mm clear space should be provided between the obstacle and the edge of the footway. If this is not achievable due to physical constraints, then a minimum width of 1500mm could be regarded as the minimum acceptable distance.
If approved, we may grant a licence for a specified period (not exceeding 2 years), and attach conditions as deemed appropriate. For further information, use the below form -
