Fixed term tenancies and our current tenancy offerings

We are considering introducing fixed-term tenancies for tenants moving into a larger home. For example, a tenancy which is for a set number of years. We hope that this will help us to help more families in need of larger accommodation. This is alongside other measures aiming to help.

Fixed-term tenancies for properties with 4 or more bedrooms will only affect new tenants and existing tenants. This is if they move into larger properties. Note that the government may introduce legislation affecting all types of tenancies. The council has to follow any new rules introduced, so this is how things stand at the moment.

The different types of tenancy we offer

Currently, we mainly provide 2 types of tenancy -

  • introductory
  • secure lifetime tenancies

Introductory tenancies are usually offered to new tenants for a period of 12 months. During this time, we assess how well the tenant manages their tenancy. We also offer support to help resolve any problems. The introductory tenancy will automatically become a secure lifetime tenancy after 12 months. It is important to know that this is if the introductory tenancy goes well. This is regardless of the size of the property they are in.

Secure lifetime tenancies are our most common form of tenancy. They offer tenants the greatest level of security. These tenancies have no fixed end date and allow tenants to remain in the property for as long as they wish. This is as long as they meet the terms of the tenancy agreement.

There may be specific situations where we have legitimate reasons to seek possession of the property. This can be unrelated to any fault on the part of the tenant. For instance, if there is a need to carry out redevelopment work on the property. In such cases, we would always offer suitable alternative accommodation to affected tenants.

A fixed term tenancy is a type of tenancy agreement that lasts for a stated period. It typically starts from 5 years. During the fixed term, tenants have similar rights and responsibilities as they would under a secure lifetime tenancy. They are entitled to enjoy all the benefits and protections outlined in their tenancy agreement. The difference is that the tenancy will end once the fixed term expires. This is unless the tenant and landlord mutually agree to extend it or enter into a new tenancy agreement.

At the end of the fixed term, the tenant and the landlord will have the opportunity to look at and assess the tenants' housing needs at that time. This review would seek to ensure that the housing needs of tenants are met appropriately. If we choose to introduce this, we will work closely with each tenant. We want to understand their personal circumstances. This will be well before the fixed term ends.

We understand that families change over time. Tenants may find that they no longer need a larger property. They might struggle to afford and maintain a larger property as they get older. Their circumstances could also change. In such cases, we will work with the tenant to find alternative housing options. These housing options will better match their needs at that time.

This may involve offering to help them move to a more suitable and smaller home. This property could be within our stock, based on what the tenant prefers and to meet their needs. For some people, moving homes can be a daunting and emotional experience. We might decide to offer fixed term tenancies to new tenants of larger properties. In this case, we will support them as the fixed period comes to an end. A dedicated team will provide help and guidance throughout the process. This includes if the tenant moves to a different home.

We want tenants to feel safe and supported throughout. It is important that everyone has access to the appropriate housing they need. This includes those needing a council home as well as those already living in one.
