Hull Local Heritage List Article 4 Direction Proposals
During 2023 and 2024 a first round of public consultation was undertaken on introducing an Article 4 Direction to manage the Hull Local Heritage List. Feedback raised concerns about what was being proposed including -
- an overall Article 4 Direction for external changes is too restrictive for maintenance and repair
- Article 4 Directions need to be relevant to special interest
- concerns over additional costs and delays because of requirements to apply for planning permission
Feedback received have been reviewed and a revised set of proposals will now be consulted on.
What is an Article 4 Direction
An Article 4 Direction is a planning tool used to help manage the character of special areas or individual buildings. We can introduce an Article 4 Direction to withdraw or alter Permitted Development rights within the 2015 General Permitted Development Order (GDPO). For example, within a Conservation Area, the GDPO allows for a resident to change the colour of property. An Article 4 Direction could be introduced to require planning permission to paint a building a different colour.
Which Local List Entries are being affected
The Article Direction is targeted at buildings and structures on the Hull Local Heritage List which are located outside of Conservation Areas. A full list of impact properties is available to download.
Proposed Article 4 Directions
To provide effective management of the Hull Local Heritage List it is proposed to introduction Article 4 Directions for -
- the demolition of a Local Listed Building
- all changes of use of a Local Listed Building
- external alterations for all Class Uses
- the cladding of a building
- the installation of external security shutters
- the installation of replacement windows
- this would be written to the effect that a window of a different design or material use would require planning permission
- Specific Article 4 Directions to secure individual elements of special interest
- the alteration of a ground floor public house facade
- the impact of the Article 4 Direction would be to retain decorative features such as tiles, and to control works such as painting over the tiles
- the alteration of a shop fronts at 45 Anlaby Road and 81 Newland Avenue
- this would include the full removal of a shop front, or alteration of an individual element such as the removal of the shop window or alteration to it stall riser
- the alteration of a ground floor public house facade
Why has the Article 4 Direction been proposed
The Article 4 Direction being proposed would achieve the following objectives -
- introduce controls over the demolition of a local listed building
- allow changes of use to be sympathetically introduced
- allow control over works which have the most potential to harm the external appearance of a local listed building
- are targeted to preserve key elements of special interest such as historic shop front and pub frontages
It is not the intention that the Article 4 Direction will stop all changes of use or external alterations, but to ensure that Locally Listed buildings are conserved in a manner which preserves their special interest.
How to provide feedback
Public consultation is taking place between Saturday 15 February and Monday 31 March 2025.
A public consultation session will take place at Hull Guildhall on Monday 24 February from 11am to 1.30pm.
